VACATION RENTAL AGREEMENT
THIS IS A VACATION RENTAL AGREEMENT UNDER THE NORTH CAROLINA VACATION RENTAL ACT.  THE RIGHTS AND OBLIGATIONS OF THE PARTIES TO THIS AGREEMENT ARE DEFINED BY LAW AND INCLUDE UNIQUE PROVISIONS PERMITTING THE DISBURSEMENT OF RENT PRIOR TO TENANCY AND EXPEDITED EVICTION OF TENANTS.  YOUR SIGNATURE ON THIS AGREEMENT, OR PAYMENT OF MONEY OR TAKING POSSESSION OF THE PROPERTY AFTER RECEIPT OF THE AGREEMENT, IS EVIDENCE OF YOUR ACCEPTANCE OF THE AGREEMENT AND YOUR INTENT TO USE THIS PROPERTY FOR A VACATION RENTAL.

We do business in accordance with the Federal Fair Housing Law (the Fair Housing Amendments Act of 1988)

Please make sure that you inspect the cabin photos, description and amenities on our web site, as there is no refund upon arrival.

1.  RENTAL FEES
Checkout cleaning and spa cleaning is included in the Rental Fee.  A Macon County Occupancy Tax of 3% and NC Sales Tax of 7% is added to all Rental Fees. Non-Holiday Reservations require a 50% Rental Fee deposit made by credit card at the time of making the reservation.  Final Balance is due at least two weeks prior to your arrival date.  If final balance is not received by due date and we have to cancel your reservation, there will be NO REFUND of initial deposit unless the cancelled reservation is rebooked, we will then refund your forfeited rental deposit less a $25 processing fee, the $15 Reservation Fee and any credit card fees, after the end of the rental.

The renter agrees that he will not claim any charge backs or credits from his credit card company for any fees charged to his credit card, including but not limited to booking, deposit, rental, additional cleaning or damage fees.

2.  We trust our guests are responsible and we do not demand a security deposit.  Guests are financially responsible for all damages and for additional cleaning fees if necessary.  Should housekeeping find the house in an unacceptable condition, we will charge your credit card or checking account or bill you for any damage repairs, replacement of missing contents, expenses resulting from agreement violations, such as phone calls, Internet charges, movie charges, check fee, trash left in cabin, dirty dishes left unwashed, furniture moving, or unacceptable condition of cabin on your departure. 

3. RETURNED CHECK FEE
There is a $30 per check fee for all returned checks.

4. CANCELLATION POLICY AND REFUNDS
We know that plans can go astray, however, we rely primarily on advance bookings and cancellations are not easily filled.  To be fair to all concerned, our policy is as follows:
If you cancel at least 31 days before your arrival date:
-All rental fees are refundable LESS $50Processing Fee/$15 Reservation Fee/All Credit Card Fees
    
If you cancel 30 days or less before your arrival date, all Rental Fees, Credit Card Fees and $15 Reservation Fee are forfeit. 
If the cancelled reservation is rebooked, we will refund your forfeited Rental Fees
LESS $25 Processing Fee/$15 Reservation Fee/All Credit Card Fees

NO SHOWS WILL BE CHARGE IN FULL, UNLESS THE CABIN IS RE-RENTED.  We recommend you look on the Internet and purchase Trip Insurance to cover the potential financial loss.


5. CHECK-IN AND CHECK-OUT TIMES
Check-in time begins at 3:00pm – While we make every effort to have your cabin ready, there may sometimes be a delay during peak season and your patience is appreciated.
Checkout is no later than 11:00am – An additional nights stay will be charged for late checkout.


6. PHONE
The cabin phones of Blueberry Hill and Laurel Ridge are a party line and have a long distance phone block.  We recommend you purchase a Long Distance Calling Card.  You are able to make local calls and dial 911 if necessary.  You are unable to take Incoming calls from friends/family - you must contact them with your phone card.  In the case of an emergency only, family may call the office 828 321-1613 and a message will be taken and delivered to you.  White Oak View has a phone with a long distance phone block.  We recommend you purchase a Long Distance Calling Card.  Your family may call you at your cabin on 828 321 4506. 

7.  MEDICAL AND FIRE EMERGENCIES
Call 911 for all medical or fire emergencies.  In case of fire or house damage also contact managers  (321 2340) after contacting 911. 

8. MAINTENANCE
Please report any problems or damages in your cabin the day of check-in to management (321-2340).  If not reported, we must assume that damage or loss occurred during your occupancy and we will have to charge you.   When maintenance needs arise during your stay please inform management as soon as possible.  It may be necessary for them to enter the unit during reasonable hours to carry out minor repairs; Renters are not required to be on the premises.

9.  Each cabin comes fully furnished, including dishes, silverware, cookware and linens (towels, bath mats, sheets, dish towels).  We also provide a two day supply of paper towels, toilet paper, trash bags and dishwashing liquid. If your stay is longer than two days we suggest you bring supplies from home.  We are not responsible for any items left in the cabins.  If you request us to return any item left in a cabin, items will be returned by the US Postal Service for a service charge of $30.00

9.  CHECK OUT PROCEDURES
On departure guests are required to leave the property in the same general condition it was when guests arrived.  If additional cleaning is required appropriate charges will be charged to your credit card or checking account.
Please ensure the following items are complied with before check out:
·Dishes, pots, pans, silverware and utensils are washed, dried and put away
·Stove, oven and kitchen appliances are clean
·Refrigerator is clean
·Charcoal grill is clean
·Windows and doors are closed, all lights turned off
·Heating thermostat is set to 60 degrees and air conditioning units turned off
·All garbage and trash is bagged and left in outside trash cans
·Hot tub temperature is set to 97 degrees
·Property is left neat and in order

10.  The minimum age required to rent a cabin is 21 years and the person who books the cabin must stay in the cabin for the entire rental period.  Sub-leasing or parents renting for their children under the age of 21 is not allowed.

11.  The maximum occupancy for each cabin must be adhered to.  Blueberry Hill sleeps and Laurel Ridge sleeps two. White Oak View sleeps four. 

12.   No mobile sleeping units, including tents are permitted at the cabins for additional housing.

13.  PETS
Sorry... we love pets too, but many guests are allergic to them and they can leave fleas in the cabin.  Therefore. ABSOLUTELY NO PETS.  Tenants bringing pets will be required to leave without refund and will have to pay an additional $100 cleaning fee.  Please leave your pet in the care of friends or a boarding facility.

14. SMOKING
Smoking inside the cabin is not permitted.  You may smoke outside on the deck, please ensure you extinguish all cigarettes and dispose of them properly to prevent fire hazard and keep the grounds clean. If guests smoke in the cabin a  $50 charge will immediately be deducted from your credit card for deep cleaning of curtains etc.  Any cigarette burns inside the cabin will be charged on an individual basis, depending on what item is damaged.

15. CAMPFIRES
A fire pit is available at the cabin and no other area is to be used for a campfire except the fire pit provided. However, please remember that fire is a threat to the area.  It is your responsibility to ensure your fire does not get out of control, you will be held personally and financially responsible if the fire gets out of control.

16.  Amenities are not guaranteed.  There are NO REFUNDS for the malfunction of any equipment including but not limited to air conditioning, TV, hot tub, appliances, power outages and telephone service.  Every effort has been made to ensure all equipment is in working order.

17.  No refunds due to weather, road conditions, change of plans or early departures.  During your winter visits, stay tuned to TV/radio/weather stations for storm warnings or watches.  Depending on the severity of the storms and your location, it is your responsibility to take necessary precautions.  We are not responsible for damages incurred due to weather or cost to evacuate your family or vehicles. 

18. DRIVING CONDITIONS
Mountain roads can be tough at any time of the year.  We do not guarantee any road surface conditions.  Most roads in our area are well maintained, but they can be curvy and steep. Our cabins have gravel drives and while these roads are routinely maintained, they may be bumpy at times.  In the late fall, winter and early spring it is not uncommon to occasionally have hazardous road conditions.  No refunds due to road conditions.  You are responsible for your transportation.  We are not responsible for any towing charges you may incur during your stay.

19. HOT TUBS AND COVERS
Read spa/hot tub warnings and instructions before use.  Hot tubs will be inspected after each rental.  If any items such as food, alcohol, soaps or bath products etc. are found in the hot tub, you will be charged an “empty and refill” fee of $50. Do not sit on the hot tub cover, it is made of styrofoam and breaks easily.   Damage to any cover will result in a $200 charge.  Covers should remain on the hot tub at all times when not in use.  Children under the age of 16, pregnant women and persons with heart conditions or skin sensitivities should not use hot tubs. 

20. GENERAL STATEMENT
All information contained herein is considered to be accurate and truthful. Rates furnishings and amenities are subject to change without notice.  In the event a home is unavailable for rental due to fire, water damage, acts of nature etc. we will do everything possible to find you equal accommodations.  If we are not able to do this all deposits will be refunded.  We are not responsible or liable to the renter for loss or theft of any of the renter’s personal property.  Accidents, injury or damage of any nature, from any cause to the renter (including guests) acts of God, weather, road, travel or skiing conditions or other recreational activities are not our responsibility.  Guests hereby agree to INDEMNIFY and hold the owner harmless from any and all claims, including those of third parties, arising out of or in any way related to guests use of premises or the items of personal property provided therein.  Guests assume the risk of injury or other losses relating to any recreational activities and will hold owner and it agents harmless and respect there to.

If Owner/Agent is forced to resort to employment of legal counsel, litigation or professional collection services in the collection of any amounts due to the Owner/Agent under this Agreement the renter shall be responsible for all costs of litigation and collection including but not limited to reasonable attorney’s fees if Owner/Agent prevails in legal action.

21. The renter is responsible for abiding by all rules, regulations and instructions in this Vacation Rental Agreement.   Any exceptions to the above mentioned the Owner/Agent must approve rental agreement in writing in advance.

22. Property owner or their representatives have the right to enter premises during tenancy to inspect, make repairs or show property for sale.

23.  CONSTRUCTION
New homes and facilities are always being built in these growing area.  Should you find yourself near construction, enjoy watching the activity and exercise patience and understanding.  No refunds or moves will be made due to nearby construction.
